    Can US Aircraft Operate Domestic Flights in Mexico?

    One of the most frequently asked questions in cross-border private aviation is whether a US-registered aircraft (with an N-number) can perform domestic flights within Mexico. The short answer is: no. But the details matter, and understanding them can prevent costly penalties and operational delays.

    What Is Air Cabotage?

    Cabotage is the transport of passengers or cargo between two points within the same country by a foreign-flagged aircraft. In aviation, this means that an aircraft registered outside Mexico cannot transport passengers or cargo between two Mexican airports.

    This restriction isn't unique to Mexico — most countries in the world protect their domestic airspace in the same way. In the United States, for example, the Jones Act and FAA regulations prohibit foreign-registered aircraft from operating domestic flights.

    The Rules in Mexico: What AFAC Says

    The Federal Civil Aviation Agency (AFAC) is the authority that regulates aviation in Mexico. Its cabotage rules are clear and strictly enforced:

    Absolute cabotage prohibition. An N-registered aircraft (or any foreign-registered aircraft) cannot fly from one Mexican airport to another Mexican airport carrying passengers or cargo. For example, a flight from Puerto Vallarta to Cancún on an N-registered jet is prohibited.

    Active AFAC verification. AFAC routinely reviews all flight plan requests to ensure no cabotage is being committed. For N-registered aircraft, AFAC directly checks the FAA website to confirm all submitted documentation is in order.

    Entry and exit rule. A foreign aircraft can enter Mexico to drop off passengers, or enter Mexico to pick up passengers, as long as the flight originates or terminates outside Mexico. What it cannot do is operate a flight that both originates and terminates within Mexico.

    What IS Allowed?

    There are legal operations that N-registered aircraft can perform in Mexico:

    Inbound flights. An N-registered aircraft can fly from any point in the US to any airport in Mexico (example: Houston → Toluca).

    Outbound flights. An N-registered aircraft can fly from Mexico to any destination outside the country (example: Cancún → Miami).

    Empty repositioning. If an aircraft needs to move between two Mexican airports without passengers or cargo (ferry flight), this is generally permitted under specific conditions and with proper documentation.

    Round trip flights. An N-registered aircraft can bring passengers from the US to Mexico and subsequently return those same passengers to the US. However, it cannot pick up new passengers in Mexico for a domestic flight.

    What Is NOT Allowed

    Domestic flights with passengers. Any flight between two Mexican points with passengers on board is prohibited for foreign aircraft.

    Domestic charter. Charter flights that pick up passengers at one point in Mexico and take them to another point in Mexico can only be operated by Mexican-registered aircraft (XA-, XB-, XC-).

    Picking up new passengers. If an N-registered aircraft brought passengers from the US to Mexico, it cannot pick up additional passengers in Mexico to take them to another destination within the country.

    Permits and Processing Times in 2026

    AFAC has tightened permit requirements for foreign aircraft:

    Demo, charter, and aerial photography flights now require permit requests to be submitted at least 10 business days in advance (previously 5).

    Blanket permits (covering multiple flights) can take up to 90 business days to process under ideal conditions.

    Increased enforcement. Stricter sanctions are expected for cabotage violations or operations without proper permits.

    If your itinerary requires flights within Mexico — for example, arriving in Toluca from Houston and then flying to Los Cabos — the solution is to use a Mexican-registered aircraft for the domestic leg.
